School bus driver on trial in fatal crash

Testimony will continue today in the trial of a former Horry County school bus driver charged with a misdemeanor traffic offense in connection with the 2009 death of a Myrtle Beach-area high school student.

Michael Joseph Burns, 78, denied being responsible for the Nov. 2, 2009, vehicle crash that killed 17-year-old Marc Chaplin. The teen's motorcycle and the school bus Burns was driving collided.

"There was a blur in front of me and that's when the accident occurred," Burns said.

He is charged with failure to yield the right-of-way. His trial began Tuesday in front of Magistrate Margie Livingston.

Chaplin was going west on International Drive while Burns was going east. Burns attempted to turn left onto S.C. 31 when the crash occurred. Horry County Assistant Solicitor Paul Taylor on Tuesday told the magistrate court jury of five men and two women that Burns did not have a green turn arrow at the time of the crash and pulled into oncoming traffic.

"He turned when he shouldn't have. He was in a hurry and negligently turned," Taylor said in his opening statements.

"In this case you will see how serious the consequences are if we don't abide by those [traffic] laws."

Chaplin, a senior at the Academy of Arts, Sciences & Technology, died after his 2008 Kawasaki motorcycle and the 2004 school bus collided.

On Feb. 5, troopers with the S.C. Highway Patrol cited Burns with failure to yield the right-of-way after an investigation.

"With the traffic patterns we saw, there was no way Mr. Burns could have had the dedicated green traffic signal," Highway Patrol Cpl. J.R. Shull testified.

"He believed he had the right to make the turn."

Chaplin, whose base school was Myrtle Beach High, was on his way to the academy on International Drive.

Several defense witnesses testified Burns had a green turn arrow and that Chaplin sped up when the traffic light in his lane turned yellow.

"I saw him speed up a lot while I was slowed down. He went into the intersection and hit the front of the bus," said Roy Cohen, a 17-year-old who attended the academy with Chaplin. "I knew he was going to try and beat the light. I knew he was going to hit the bus."

During his testimony, Cohen said Chaplin had a reputation around school as being a "reckless driver" on his motorcycle.

Prosecutors plan to call witnesses to rebut that testimony today, while Burns' attorney, Gene Vaught, said he had witnesses to confirm it.

No students were on the bus at the time of the crash, and Burns was returning to North Myrtle Beach High School after dropping students off at the academy, authorities said.

Alvin Weinerman, who was driving another school bus behind Burns that morning, testified he saw parts of the bus flying in the air after he heard a loud noise.

"Was there a green turn arrow?" Vaught asked Weinerman.

"Yes, there was," Weinerman said.

"Is there any question in your mind about it?" Vaught asked.

"No," Weinerman said.

Burns has driven for the school district for five years and drove for a North Carolina school district for 13 years before that, he testified.

He was found guilty of the same failure to yield charge in December 2007, according to Horry County records, although details on the incident weren't available Tuesday.

If Burns is convicted, points could be assessed against him on his driving record and he could face a fine.

Chaplin's parents, who attended the trial but did not address the court, have sued the school district and state department of education for neglect, according to a lawsuit filed Nov. 2 in Conway.

Rodney and Cathleen Chaplin are seeking $600,000 for actual damages and legal fees in the suit.

The Chaplins seek compensation for the "extreme emotional anguish, lose of care, comfort and companionship" by their son's death. They also seek to recover compensation for doctor fees, hospital bills and funeral expenses.

Police seeking Little River man after fatal shooting

Horry County police are looking for a 24-year-old Little River man after a weekend fatal shooting in Longs, according to a news release from Sgt. Robert Kegler.

William Dearck Landy Jr. is about 5 feet, 6 inches tall, weighs about 170 pounds and has black hair and brown eyes.

Detectives believe he is operating a black 2004 Chevrolet Impala SS with a state tag of GQI 249.

Landy is considered armed and dangerous, Kegler said.

Horry County police say an arrest warrant has been issued charging Landy with murder. Police responded about 7 p.m. Sunday to Grand Strand Regional Medical Center after a man with a gunshot wound to the upper body sought help, Kegler said.

The victim was brought to the hospital after being shot on Pint Circle in the Longs section of Horry County, according to Kegler.

Lakeem Omar Bellamy, 18, of Chestnut Run Road, died at 1:15 a.m. Monday, Horry County Coroner Robert Edge, Jr. said.

Detectives are asking anyone with information on the location of Landy to contact them at 915-5350 or 248-1520, or 915-TIPS (8477) if one wishes to remain anonymous.

Police seek public's help after fatal shooting in Myrtle Beach area

Horry County police are seeking information from the public about a weekend shooting that left one man dead, according to a news release from Sgt. Robert Kegler.

The body of Joseph Sourdiff, 48, was found at his home by his son, Shahin Darius Sourdiff, on Saturday morning.

Police said Joseph Sourdiff died from multiple gunshot wounds at his home on Teague Road, in the Harbour Towne community by the Intracoastal Waterway.

Kegler said Monday that police are still investigating whether the son is a suspect in his father's death.

Shahin Sourdiff was arrested Saturday, but not in connection with the shooting. He was charged with first-offense manufacturing marijuana, according to jail records.

The 20-year-old was taken to the J. Reuben Long Detention Center on Saturday and released Monday on a $30,000 bail, jail records show.

Horry County's Lt. Raul Denis said evidence at the scene showed the shooting took place at the home.

Police, who responded around noon Saturday to the home, believe Sourdiff was killed about 24 hours before his body was found, Kegler said.

Shahin Sourdiff told police he found his father dead when he arrived at the house about 11 a.m. Saturday. According to police records, the younger Sourdiff doesn't live at his dad's home.

Detectives are asking that anyone who lives or was in the area of Teague Road between 11 a.m. and 3 p.m. Friday and may have seen anything suspicious to contact police at 915-5350 or 915-TIPS.

Detectives also are hoping to identify the driver and/or occupants of a blue sport utility vehicle and a white box van with blue markings, both of which were seen driving down Teague Road during that time period.

Glendale victim identified fatal knife

Glendale man who was stabbed fatally Friday at 5: 30 p.m. has been identified as Jesse Encinas, police said.

Encinas, 44, appear to be stabbed outside of his home near 67th Avenue and Missouri, Glendale Sergeant Brent Coombs.Cependant, police spokesman said he was able to to his house where a family member called 911.

Encinas was transported to hospital where he died later in the morning to injuries to the upper torso, said Coombs St. Joseph.

No attackers have been taken into custody and police are still investigating.

Free of charge filed in Murrells Inlet fatal shooting

No charges will be filed against a 76 year old Murrells Inlet man who killed his son-in-law week last in a quiet golf community.

Police, said Monday that Sean Johnson, 48 years old, arrived at the House of his mother on Court Winged Foot Indigo Creek Golf Club community about 3 p.m. Thursday.

Johnson soon pulled a gun on 72-year-old mother and that the woman is fled to the bathroom, father-in-law of Johnson grabbed a gun to protect himself and his wife, Sergeant Robert Kegler Horry County Police said.

Johnson later weapons punched his father-in-law, who fatally wounded, said Kegler.

When officers arrived, the father-in-law was in the driveway and officers, said "" I got the faire.Il crazy ".".

Horry County records indicate the House, located approximately 75 metres from the 16th green of the golf course, are owned by Eric and Pat Trenck.

Kegler said investigators spoke with attorneys with the fifteenth judicial circuit and ruled the filming of a justifiable homicide.

Horry County Coroner Robert Edge said Monday that there is no sign of a "physical confrontation" on the body of the victim during an autopsy, last week.

Said edge Toxicology screen has been made, but the results should not for about six weeks.

After the shooting, officials confirmed the same man who held members of the Sheriff of Georgetown County at Bay for nine hours in August after that his girlfriend Johnson reported a handgun in him.

Girlfriend of Johnson and the Trencks refused to comment on Monday.

Police said that Thursday, Johnson struck at the door when he arrived at the House of his mother, but without being prompted.

He was "very agitated" to his mother, call 911 incident of domestic violence in August, according to a report of an incident.

Police threatened to kill his mother, his father-in-law and himself while in the House, said Johnson.

He started ransacking the House by launching documents and later sheared his glasses, break.

Mother Johnson locked herself in the bathroom and Johnson Hall started to knock on the door, according to the report.

The father-in-law grabbed a firearm in a table in the living room and then approached Johnson weapon behind his back.

He said police Johnson said "stay out of this or I will get you" everything by telling her mother "you ruined my life."

The father-in-law said agents that he fired his weapon to Johnson when Johnson was a weapon on him.
